submitting (as sole writer) published songs to TAXI

Post by foursouls » Sat Feb 14, 2015 11:06 am

I had written, recorded several songs and signed "forever" publishing contracts in the 1960's. Recently tried to "buy back" the rights from the publisher - answer was they would split publishing 50/50 for any deals I would get. Given this info - can I submit these songs to TAXI?

i would call TAXI and ask their opinion, but my impression (not being an entertainment attorney) is.....

TAXI deals can be roughly split into two camps:

1) direct to agency or music supervisor placements

where you would (usually) retain 100% of the upfront payments from any placement (assuming that such fees were offered) and 100% of writers royalties and 100% of publishers royalties

2) publisher placements

where the Publisher (which could be a smaller entity or a library) usually takes 50% of any upfront payments and 100% of the publishing leaving you with 100% of the writers share.

Since your pieces are already "encumbered" by the existing publisher, I don't think you would be able to submit for any deals similar to #2 - as whatever publisher you get interest from would want 100% of publishing and its not available in this case.

but that's an opinion.

Andy's math sounds right to me.

if you wanna shop those songs you will need to go direct to supe and not the ones that want part of the publishing.
