My song's been ripped by RedBull.com producer:(

If anyone has any advice, please share anything you think might be helpful?

Yesterday, a Facebook fan congratulated me on my song being placed in a RedBull ad on YOUTUBE. Surprise to me...he was kind enough to send me the link and there's my song Long Hard Train being used throughout the video. 42,000 hits so far in a couple of days.

I contacted AdRev.net (ascap recommended them) but before they move in to shut it down, I've called my lawyer and we should have a plan tomorrow to possibly threaten with a suit. Unbelievable that the producer Marcos de Souza has the savvy to copywriter his own video, but did not contact me to license my song.

wow... just checking new posts: don't recall reading one quite like this.
At minimum, the bright side is: someone thought your material was "right for the listing',
and a fan was considerate enough to contact you with props;
and, fwiw: congrats on an awesome placement.

Be smart about it. Fact is a producer has already put your music in a major commercial!
They are already using your music commercially, so if you play it right, it might turn into a really cool deal for you.

No question that this brand is in trouble if they have used your music without permission. When they realize that, you are in a very good bargain position.

Kolstad, I hear you. I expect my lawyer will go for a deal of some sort; that is why I'm not letting AdRev run with this. Obviously, I'd prefer to treat it like it's an "oversight" and your words hit home, thanks, L

Thank you; I like the idea of a silver lining. Spoke with my lawyer and we are taking the "must be on oversight on your producer's part" stance before we suggest anything more assertive. He is handling it and I'm grateful for his help. And, You are all good advisors when I'm in the heat of it! ! Les

Is this track signed to a publisher? If so, are you sure they didn't place it? Sometimes the paperwork can take a while to process.

Just another thought.

My first thought was the same as Kayle's, I assume this song is not signed to a publisher? And how did they get the file? Soundcloud or something? And if so, they are using a compressed file for a major ad? Weird...

HI EO and KC,
Never signed with a publisher; I submitted it to a taxi op and got forwarded but to a music sup/tv op. not sure how this producer person got it but all my songs are out there: radio, internet, cd sales, etc. How can you tell it's a compressed file eo? at any rate, anybody can rip anything. It may be on sound cloud; it didn't check. Fingers crossed it all turns out ok. At least, on the bright side, it sounds cool with the video:) L
