Exclusive Library Question
If I have a song up on Pond5 (royalty-free music site), can I submit this to a library that deals with an exclusive license? Thanks.

Pond5: "You hereby grant us the world-wide, non-exclusive right and license throughout the world, to directly and/or indirectly copy, market, promote, distribute, sell and/or grant non-exclusive licenses to your Content."
Under these terms you cannot also sign that track to an exclusive library.

My basic understanding (not legal advice) is that 'exclusive' effectively means 'to us, only us, and no-one else'.
Therefore, although tracks can be signed 'non-exclusively' to multiple publishers,
they can be signed 'exclusively' to only 1 publisher.
Consequently, you can't have 'exclusive' deals AND 'non-exclusive' deals on the same track.
Its always a good idea to seek proper legal advice on all your contracts for absolute clarity and understanding.
