Quote:Once a piece is sent to Oprah, it becomes hers. It's a work for hire agreement. In a true work for hire arrangement the composer does not make anything on the back end, does he? Does she pay you a one-time fee and that is the end of it? In other words is it like a buyout?

In other words is it like a buyout? In this particular work for hire situation, a composer fee is paid for each accepted piece, Oprah becomes the publisher and copyright holder but the composer retains writer's share of the performance royalties. All of the potential income is backend. That's why 90 placements is such a great thing!

imagine if John Williams and Trent Reznor met at Bernard Hermann's for lunch and Brian Eno was the head chef!

Re: Some recent successes
Thanks everybody! Quote:In a true work for hire arrangement the composer does not make anything on the back end, does he? Does she pay you a one-time fee and that is the end of it? In other words is it like a buyout? This is one of the biggest misconceptions in the music industry. A work for hire is NOT a buyout, at least not in 90% of the cases where the term is used.It simply means that the employer is the owner of the compositions, therefore the rights will never revert to the writer.Work for hire agreements are used in the vast majority of major tv and film productions, and the composer always retains his writer's share. That doesn't mean you shouldn't be cautious with this (as with any other) type of agreement and make sure they're not trying to sneak something by you...

With all those quality compositions Oprah could easily start her own library anytime she wanted.

Re: Some recent successes
Steve, if you don't know when you're smart, just assume you are all the time. Whether you are or not, you'll never know the difference. (until people start saying things to you like "man, you're smart" or "man, were your parents cousins?")
