Re: Disney Terms of Use
What exactly is it that you want to do, here? It's not clear which of the mentioned sites you're proposing to use, nor why, so I have no frame of reference as to what all the boilerplate means. You are not to submit any original song or composition unless you are a member of ASCAP, BMI or some other PRS, on the one hand, and on the other, they're saying they basically own anything that you post to the site(s). I'd like to help, but I need more info.I think section 4 paragraph 1 means you grant them the right to perform and/or modify your composition without notification, consent or compensation. The streaming of a file might be defined as a performance, for legal purposes. There's also some stuff about appointing them as your agent and use of their copyrighted materials for derivative works; are you submitting for some sort of contest?*edit*Ah, if you're not the winner, they retain the right to perform/broadcast the work or use it in modified form, but I think you retain copyright and should receive royalties, just possibly not from Disney's uses of the work, if I'm reading it right-by submitting you're giving them a blanket license, but it's non-exclusive; you can still flog the piece elsewhere...I am not a lawyer.
