mechanical licensing for MP3s ?

Post by littlejohn » Sun Aug 02, 2009 9:05 am

How does mechanical rights licensing relate to MP3 web download ?I recently asked the question ( from a publishing perspective ) whether or not an MP3 was considered "tangible" in the legal sense. the answer came back overwhelmingly - YES. If that be so, ( Tor F ?) I would expect anyone seeking to record and sell an MP3 of a song of which I own the copyright to first gain the appropriate mechanical license ( just like with a record or CD )I wonder if the popular download sites report sales to say Harry Fox or anyone like that ( on a per sale basis ) ??TIA for the chat -- Best , --John

johnI just licensed three cover songs for my new cd from harry fox. it's a seperate license for mechanical and mp3 downloads .I had to apply before they were made available for sale. I think the rate .09$ per. is the same as mechanical scott

What factors did you consider when choosing the number of mechs for MP3 distribution ? I ask , because choosing the number of mech lic.s is a straightforward calculation for CDs ( i.e. I am going to make X number of CDs and I know that in advance )From what I can tell there is a mech lic. due for each MP3 download sale .. maybe not so easy to predict, and possibly harder to confirm/audit ( hooray for Harry if he intends to try !)
