non-exclussive - shall I submit anyway?

Post by gitarrero » Wed Oct 31, 2007 9:03 pm

hi,this is the listing:****MTV-like URBAN/RAP/HIP HOP SONGS (w/ vocals) along the lines of Chamillionaire, 50 Cent, Twista, T.I., Mary J. Blige, Fabolous, Young Jeezy, Queen Latifah, R. Kelly, etc. are sought by the Music Coordinator of a Cable TV Network for numerous shows she's working on. No lyrical theme restrictions, but no profanity -- clean versions only. No need to submit instrumentals, but if the music coord. is interested in licensing your song, she may ask for an instrumental version, so having one on hand is recommended. Great performances are essential. No uncleared samples. If forwarded for S070522UR, no need to submit the same material. Broadcast quality needed [great sounding home recordings are OK]. All submissions will be screened on a YES/NO BASIS ONLY -- NO CRITIQUES FROM TAXI. For ground submissions, please enclose a S.A.S.E. if you would like a response. Submissions must be received no later than Nov. 29, 2007.TAXI # Y071129UR******...I have a song that would be a good match - but this song is under a non-exclusive (re-titled) contract with an L.A. based library (who does fantastic work btw).my question:I know that I'm basically allowed to submit this track from a legal standpoint - but is it recommended..?any comments from people with experience in that field?thanks, martin

I would submit and see if it gets forwarded. If yes, and you get interest from this music coordinator, shoot the library in LA an email and ask them if they pitch to this network. If no, go ahead (assuming you like the terms of the deal). If yes, I would probably not sign a deal with the network's music coordinator to avoid potential conflicts. But...you could maybe offer her other songs at that time and try to eploit this new relationship that way.Make sense?matto

Hi Martin,I agree with Matt. Send it in, because even if you don't do a deal on this one you could whip up another track if you get forwarded and contacted by the publisher with interest.I took a listen to your hip-hop tracks on your website and you are definitely in the ballpark.Go for it.Cisco

Depends on what the non-exclusive contract's guidelines are. Take a copy of the contract to a music lawyer for definition, or simply contact the company holding the contract and let them know what you are doing and ask them where your obligations lie regarding moving the work on your own, and then take it to a music lawyer no matter what they say.Either way, best of luck!
