Hi,

Can someone clarify the statement "VOCAL PERFORMANCES ARE CLEARED for film/TV use" that appear in listings.

My assumption is that you have a work for hire agreement signed with your vocalist (if the vocalist isn't you), that releases them from any participation in the song other than the session fee you paid them (you need to sign an agreement even if you aren't paying them, I would suggest you pay them at least 1.00 so some money changes hands).

The same goes for any session players you may use as well. This is for US placements, as we discussed extensively in another thread, other countries may not have this requirement.

Bottom line, if someone performs on your songs, instruments or vocals, you need to get a work for hire signed before you set up a microphone. In fact, it's good practice to check with them at the time you are booking them to make sure they are comfortable with and understand what they are signing. This will save you and them some embarrassment and hassle if you were to spring it on them at the session.

I'm not a lawyer so this info is just from my own experience and study. I suggest you call Taxi for the most up to date and definitive information as it relates to this specific listing.

I had no idea that this is what it meant although I understand the principle of work for hire agreements. Cool.

I'll perhaps call TAXI to clarify this against one particular listing.

Official response from TAXI:


It just means that if you are the producer or writer of the songs, that you
have clearance by the artist doing the vocals to be able to submit the song.
It means you should have ownership of the song so that whoever wants to
license it from you, that they won't have any trouble with any third parties
being involved.
