free samples on condition of giving credit -FINAL RESULT!!
Hi Folks,
Following on from previous posts in my thread on this subject just thought I'd give you the final results of this issue.
As I was unsure whether I could use the `free` samples in question I contacted the owner again (had checked back in 2011 and was told I could use samples for anything I wanted provided I gave a credit).
this time I outlined what I would like to do with the samples ie incorporate them into a song with a view to pitching to music libraries in order to seek Film/TV placements. I made clear that I would not be able to give a credit but asked whether it would be acceptable to the owner if I made a payment to him in lieu of a credit. Effectively I requested buying a license to use the samples.
The response was a quite emphatic NO!!, you can't buy the samples to re-sell to a library. I attempted to make clear that this was not my intention but simply to make a payment as a substitute for a credit (not to buy them). It seems clear to me that the word `library` in this case had been misunderstood to be perhaps a royalty free library or something similar.
I made it clear that I understood the response and would not be using the samples in the song as I could not fulfill his terms and conditions, I am really glad I checked even though I am disappointed as they were perfect for the track!
