Retrospective Publishing

This will probably sound a bit Irish but under the circumstances........................

If I have some pieces out there and they start picking up some plays,air time,licenses etc etc and I haven’t already assigned publishing.

Is there any reason why I couldn’t form my own publishing or is it too late after the even,the event being, the tracks already in the public domain.


I should say,these are pieces that I didn’t think were good enough to place in libraries but some people thought differently.

My library work is fastidiously monitored and overseen.

don't know about the UK....

but in the US, if you are a BMI member for example, they have a thing called excess writers clearance. So if you don't already have a publisher who has signed the piece, it sort of works like this.

Registering a song as just the writer isn't a problem, they actually give you 200% of the song to account for the publishing side as well. its a crazy system. You can go in after the fact and split that out to say be 100% writers for Michael and 100% publishers for Michael's pub(lishing) company.

You should contact PRS and ask them how it works with them.

Here in the US, with BMI you don't need a publishing company to collect publisher's share. But with ASCAP, you do.

Also, here in the US, PROs generally look back 6 months so if you sign up after there has been airplay, it should be caught.

Obviously, I know nothing about how it works across the pond. :)
