pick your brain??

Howdy All!! I know this is a long shot but, I'm wondering if anyone out there in Taxi land has any experience in co-publishing issues such as: If two partners publish music together through PRO (with no written contract/agreement), how would it be possible to dissolve the partnership while retaining the appropriate publishing rights for each partners songs. I'm in a situation where I'm out producing my partner by 4 to 1 and i'm wondering where i stand (assuming we ever split). I know this is most likely music attorney stuff, but there's a lot of smart cookies on this forum- so, what the hay. Any input would be greatly appreciated!! Congrats on all the recent deals---May we all kick ass in 08!!!jk

You split, you each write new songs on your own & register them on your own. (I see no reason why partner should expect the other to write with them all the time. If however, you don't want them to write with you anymore, that's another kettle of fish) However, if the partnership is dissolved & one of the partners is angry, it doesn't bode well for negotiating deals for the shared songs in the future. Before splitting, I would ask the partner to sign a co-writing agreement with a reversion clause of maybe 3 years (assuming your contributions can be separated) for the co-written works. This is exactly why co-writing agreements should be signed up front so all parties know the framework of the agreement.But now I read your post again and I note that you said you "published" the songs already... have they been released commercially or do you have any deals for them right now?

How many songs have you co-written with this entity?co written about 25----- I co-published all 470 (but not co-wrote)How many songs have you written in your life? about 470+How many more do you plan to write, before your don't anymore? i write about 100 year now-that should speed up when I get a robotic wife.thanks steve--go easy on my dumb ass!

we have a good bit of licensing deals floating around.....its tricky stuff, we were totally young and green when we started this and we assumed we'd both produce similar amounts--6 years later, I'm way ahead in compostions..thanks again yall!!

so you co-wrote a pile of songs, and then signed them to a jointly owned, publishing company you guys started? are these all songs with lyrics for artist pitches, or are they more library-style placements? how are the majority of your jointly written songs, positioned in the marketplace? what do you want to do that you can't do right now?

Firstly, I don't think you are giving us enough details to even begin to help. OTOH I guess I don't understand what the problem is. Unless you are giving a share of your non-co-written songs to this person because they own 50% of your legal business called xyz music publishing, and you feel that's unfair because you write 10 songs to every one of theirs. Why do you share anything with them if they haven't contributed? And why have you entered into an agreement with them without anything in writing? Too many questions to understand the problem. Or maybe it's just too late at night for me, lol.
